Himayədarın (vəlinin) icazəsi: Aişə (Allah ondan razı olsun) Peyğəmbərin (Ona və ailəsinə Allahın salavatı və salamı olsun) belə dediyini rəvayət edir: "Himayədar tərəfindən nikahı bağlanmayan qadının nikahı batildir, nikahı batildir, nikahı batildir. Əgər belə nikahla qadına yaxınlıq edərsə verilən mehr qadına qalır. Əgər himayədarlar (qızı ərə verməkdən imtina edərək) mübahisə edərlərsə (himayədar yox sayılır). Himayədarı olmayana isə rəhbər himayə­dar­lıq edər"[15]. 2. Şahidlərin mövcudluğu: Aişə (Allah ondan razı olsun) Peyğəmbərin (Ona və ailəsinə Allahın salavatı və salamı olsun) belə dediyini rəvayət edir: "Himayədar (vəli) və iki ədalətli şahid olmadan bağlanan nikah düzgün deyil"[16]. Qadını ərə vermədən öncə bu haqda ondan icazə almaq vacibdir: Himayədarsız nikah bağlanmadığı bir şərtdirsə, himayədarın ərə verdiyi qadından bu haqda icazə alması da vacibdir. Əgər qadın razı deyilsə himayədarın onu məcbur etməsi qadağandır. Əgər o, qadını məcburi olaraq ərə verərsə qadının həmin nikahı ləğv etməyə hüququ vardır. Əbu Hureyrə (Allah ondan razı olsun) Peyğəmbərin (Ona və ailəsinə Allahın salavatı və salamı olsun) belə dediyini rəvayət edir: "Dul qadının əmri, bakirə qadının isə icazəsi olmadan onlar üçün nikah bağlanmaz. Orada olanlar dedilər: Ey Allahın elçisi, bakirə qadının icazəsi necə olur? Peyğəmbər (Ona
