Kann man dies wirklich mit so einer Leichtigkeit tun? Ist diese Bezeichnung kein Eintreten in die Absichten (der Gelehrten)? Denn mit dieser Bezeichnung stürzen sie Großgelehrte wie Ibn Bāz, Ibn ʿUthaymīn und Al Fawzān! Selbst wenn wir annehmen würden, dass ein Gelehrter in seinem Umgang mit einem bestimmten Herrscher einen Fehler macht, verdient er es mit dieser Bezeichnung beworfen zu werden und dass man ihn sofort stürzt? Diese Bezeichnung ist zu einer Bezeichnung für jeden geworden, der den Jugendlichen in ihren politischen Meinungen nicht zustimmt usw. - ich erhoffe mir eine Klarstellung. Sh. ʿAbd Al Ākhir Ḥammād Al-Ghunaymī: Alles Lob gebührt Allāh, sodann: Es gibt in den Texten der Sharīʿah nichts mit dem Namen „Palastgelehrte", sondern die Texte der Sharīʿah deuten auf das Verbot des Schmeichelns bei den Leuten der Falschheit hin und dazu gehört das Eintreten bei den ungerechten Herrschern ohne sie zu kritisieren. Und zu den Beweisen des Verbots des Eintreten bei den ungerechten Herrschern, gehört die Aussage des Propheten: (...wer sich dem Sulṭān [Herrscher] nähert, wird in Fitna gebracht) {dies ist bei Abū Dāwūd und al-Tirmidhī überliefert vom Ḥadīth des Ibn ʿAbbās mit authentischer Überlieferungskette}. Und von Umm Salama wird überliefert, dass der Prophet sagte: (Ihr werdet Herrscher bekommen, von denen ihr einige anerkennen und andere missbilligen werdet. Wer sie nicht mag und sie missbilligt wird sicher sein aber wer mit ihnen zufrieden ist und ihnen folgt, den entfernt Allah von sich) {überliefert bei Muslim}. Deshalb ist es die Pflicht der Gelehrten sich von den ungerechten Herrschern fernzuhalten, es sei denn sie gebieten ihnen das Gute und verwehren ihnen das Schlechte. Und zu den Bedingungen dessen gehört nicht, dass dies öffentlich stattfinden muss, genauso wie es nicht ausschließlich im Geheimen stattfinden muss. Sondern der Gelehrte betrachtet den Vorteil und wenn er der Meinung ist, dass der Vorteil in einer geheimen Naṣīḥa liegt, tut er dies und wenn er der Meinung ist, dass der Vorteil im öffentlichen Kritisieren liegt, tut er dies und diese Sache zu beurteilen ist diesem Gelehrten überlassen. Und beides ist authentisch von den Ṣaḥābah überliefert worden. Was die Naṣīḥah im Geheimen angeht, so ist ein Beispiel dessen, das was Muslim in seinem Ṣaḥīḥ von Usāmah bin Zayd überliefert, dass zu diesem gesagt wurde: (Gehst du nicht zu ʿUthmān und redest mit ihm?) Worauf er sagte: (Glaubst du, dass ich nicht mit ihm rede, nur weil du es nicht hörst? Bei Allah, ich habe mit ihm unter 4 Augen geredet ohne dass ich eine Sache öffentlich mache, die ich nicht öffentlich machen will). Und was die Naṣīḥa in der Öffentlichkeit betrifft, so ist ein Beispiel dessen was al-Bukhārī von Abī Saʿīd Al-Khudrī überliefert, dass dieser Marwān Ibn Al-Ḥakam kritisierte, als dieser mit der ʿĪd-Predigt vor dem Gebet begann. Abū Saʿīd sagte: (Ich packte ihn an seinem Gewand und er zog es und stieg auf die Kanzel und gab die Predigt vor dem Gebet, ich sagte zu ihm: „Bei Allah, du hast [die Sunnah] verändert."...) Und Imām Al-Nawawī sagte (sinngemäß): (Wenn es möglich ist, ist es angebracht mit den Befehlshabern Benehmen zu haben und sanftmütig zu sein und sie im Geheimen zu ermahnen und ihnen zu übermitteln was die Menschen über sie sagen, damit sie damit aufhören. Und wenn dies nicht möglich ist, soll man öffentlich kritisieren, damit die Grundlage des Rechts bzw. der Wahrheit nicht verlorengeht.) Und in jedem Zustand ist es angebracht gut von den Gelehrten der Ummah zu denken und sich darin zurückzuhalten, sie voreilig als „Palastgelehrte" zu beschimpfen oder ähnliches. Und dies heißt nicht, dass die Gelehrten fehlerfrei sind, sondern von jedem wird seine Aussage akzeptiert oder abgelehnt, außer vom Propheten. Und wir müssen die Fehler diese Gelehrten erklären, ohne öffentliches Anprangern, ohne Kritik an ihrer Person und ohne ihre Würde anzutasten. Und Allāh weiß es am besten.
