Sie tragen die Dawa zum „Modernismus", und würden gerne sehen, wie wir die westliche Lebensart akzeptieren, nur weil der Westen stark ist. Solch eine Dawa ist in Wirklichkeit ein Teil des Kreuzzugs gegen den Islam, der unter dem Deckmantel des „Kampfes gegen Terrorismus" geführt wird. Die „Modernisierer", die in den Höfen von Blair und Bush sitzen, und diejenigen, die den tyrannischen Regenten in den muslimischen Ländern zu Füßen liegen, meinen, dass der Islam von Zeit zu Zeit und von Ort zu Ort veränderlich sei. Die Konsequenz daraus wäre, dass einige Regelungen des Islam nicht angewendet werden würden, weil wir in einer neuen Umgebung und in einem neuen Zeitalter leben. Demnach müssten Regelungen bezüglich Riba (Zins), der Ehe, des sozialen Zusammenlebens und den Regierungssystemen modernisiert werden. Verfechter dieser Vorstellung führen als Beispiel Imam Shafi'i (ra) an, um ihre Ansichten zu rechtfertigen. Salam Al-Maryati, ein Akademiker aus dem Irak, schrieb im Januar 2002 an das US State Department bezüglich des Themas „Modernisierung im Islam" Folgendes: „Tatsache ist, dass Shafi'i zwei Denkschulen hatte. Eine, als er im Irak lebte, und eine, als er nach Ägypten zog. Als er diesbezüglich befragt wurde, sagte er, dass der Grund dafür sei, dass es (im Irak und in Ägypten) zwei verschiedene Arten von Menschen gab. Wenn der Ort variabel ist, dann kann die Zeit ebenso ein Faktor sein." Um darauf näher einzugehen, müssen wir zunächst einmal das Leben des großartigen Imam und die Umstände, denen er in Bezug auf Ideen und Methoden ausgesetzt war, betrachten. Muhammad ibn Idris ibn al-Abbas, al-Imam al-Shafi'i, Abu Abd Allah al-Shafi'i al-Hijazi al-Quraishi al-Hashimi al-Muttalibi (gestorben 204 AH), von der Familie des Propheten (saw), sicherlich einer der größten Mujtahidun und Juristen, geboren in Gaza im Jahr 150 AH, dem Jahr, in dem Abu Hanifa starb. Im Alter von zwei Jahren zog er nach dem Tode seines Vaters nach Mekka, wo er aufwuchs. Zunächst studierte er die arabische Sprache und Dichtkunst, bis er sich mit dem Fiqh auseinandersetzte und mit der Hadithwissenschaft anfing. Er lernte von zwei großen Gelehrten, Muslim bin Khalid al Zingi, dem Mufti von Mekka und Sufiyan bin Uyaynah, möge Allah mit ihnen zufrieden sein. Er lernte im Alter von sieben Jahren den Qur'an und im Alter von zehn Jahren Imam Maliks Muwatta auswendig. Bereits zu dieser Zeit vertrat er seine Lehrer, sollten diese mal verhindert sein. Im Alter von dreizehn Jahren zog er nach Medina, um Imam Malik, der seinerseits sehr beeindruckt von der Lernfähigkeit und Intelligenz Imam Shafi'is war, zu treffen. Während seines Aufenthalts dort, wurde er durch die Methodenlehre von Imam Malik beeinflusst. Anschließend zog er nach Bagdad, wo er Schüler der hanafitischen Rechtsschule wurde, so z.B. bei Imam Mohammad bin al-Hasan al-Shaybani. In Bagdad kam er mit der Methodenlehre der hanafitischen Rechtsschule in Kontakt. Er verfeinerte seine Fähigkeiten durch ständige Debatten mit den hanafitischen Rechtsgelehrten, wobei er stets die Position von Imam Malik einnahm. Dabei erkannte er die Schwächen der malikitischen Denkweise, was einen großen Einfluss für die Entscheidung Imam Shafi'is hatte, seine eigene Rechtsschule zu gründen. Nachdem er für einen kurzen Zeitraum wieder in Mekka war, kehrte er nach Bagdad zurück. Dort schrieb er die „alte Version" seiner al-Risala, ein Buch über den Usul al-Fiqh. Diese Version ist nicht mehr erhältlich, wird jedoch von Gelehrten, wie beispielsweise al-Fakhr al-Razi, zitiert. Schließlich entschied sich Imam Shafi'i Bagdad zu verlassen und nach Ägypten zu ziehen, wo er sich niederlassen und seine Zeit in Fiqh und Methodenlehre investieren konnte. In Ägypten wurde er durch die Methode von Imam Laith ibn Saad beeinflusst. Dieser war ein außergewöhnlich wissender Mujtahid. Es wird über Imam Shafi'i berichtet, dass er sagte: „Laith war ein größerer Faqih als Malik, doch seine Schüler ließen ihn verkümmern (indem sie seine Lehren nicht aufrecht erhielten)." (Siyar i'lam al-nubala', 8/156) In Ägypten schrieb er, nach diesen neuen Erfahrungen, die neue Auflage seiner Risala. Dies sagt uns, dass er im Hinblick auf sein Verständnis des Usul al-Fiqh reifer wurde. Wieso veränderte Imam Shafi'i seine Methodenlehre? Nicht das Umziehen von einem Ort zu einem anderen ist der Grund dafür, dass Imam Shafi'i seine Methode veränderte. Dies ist eindeutig nachweisbar. Die Veränderung seiner Umgebung hatte nichts mit der Veränderung seiner Methode zu tun. Die Veränderung in seiner Methodenlehre rührt aus der Veränderung seiner Art zu denken her, was letztendlich die Veränderung von Imam Shafi'i ausmachte. Imam Shafi'i definierte seine Usul (Rechtsgrundlagen) und schrieb diese in seiner „alten Version" der Risala im Irak nieder, bevor er in Ägypten ankam und sich dort niederließ. Er begann mit dem Aufschreiben seiner Usul vor dem Ende des zweiten Jahrhunderts. Es wird berichtet, dass er bereits in jungen Jahren mit dem Schreiben seiner Usul begann, das Geschriebene des Öfteren prüfte und Veränderungen vornahm, bis er in der Lage war in Ägypten seine „neue Risala" zu verfassen. Wenn man sein Leben betrachtet, sieht man, dass Imam Shafi'i mit zwei verschiedenen Fiqh-Schulen zu tun hatte. Er schrieb seine erste Risala, und als er in seinem Denken heranwuchs, ließ er sich nieder und schrieb seine zweite Risala. Dr. Muhammad Baltaaji schreibt in seinem Buch „Manahij ul Tashri al Islaami fil Qarn al Thani al Hijri" (Die Methoden der islamischen Rechtssprechung während des zweiten Jahrhunderts nach der Hijra): „Shafi'i wurde für seinen kontinuierlichen Wandel kritisiert. Doch er reagierte auf die Kritik. Ibn Abi Hatim berichtet, dass Imam Shafi'i Amr Bin Sawad al-Serhi fragte: „Wieso schreibst du mein Buch nicht ab?", doch dieser schwieg. Anschließend sagte eine dritte Person: „Er denkt, dass du Dinge geschrieben hast, diese verändert hast, erneut geschrieben und sie dann wieder verändert hast". Diese dritte Person war der Ansicht, dass der kontinuierliche Wandel von Imam Shafi'i der Grund war, wieso al-Serhi die Bücher von Imam Shafi'i nicht abschrieb. Imam Shafi'i antwortete: „Nun ist es ausgereift." (Vol. 1 Seite 65) Auch Imam Ahmad bin Hanbal wurde einst von Mohammad bin Muslim ar-Razi gefragt, welches Buch von Imam Shafi'i er wählen sollte. Ahmad antwortete: „Suche dir eins von den Büchern aus, die in Ägypten verfasst wurden. Im Irak schrieb er Bücher, die nicht sehr gut geworden sind. Dann ging er nach Ägypten, wo er seine Bücher auf eine tiefgründigere Art und Weise verfasste." (The Methodologies of Islamic Legislation During the Second Century Hijri Vol.1, Seite 31) In Ägypten wurde Imam Shafi'i durch den Fiqh von Imam Laith bin Saad beeinflusst. Imam Laith starb im Jahr 175 nach der Hijra. Er lebte in Ägypten, doch reiste er nach Bagdad, wo er Imam Abu Hanifa persönlich traf, und die Chance bekam, Ibn Shihab al Zuhri, Nafi' und weitere zu treffen. Imam ibn Hajr sagte: „Das Wissen der Tabi'in starb mit Laith". Tatsache ist auch, dass Imam Laith der Shaykh von Imam Malik war. Imam Shafi'i kam vierzehn Jahre nach dem Tod von Imam Laith nach Ägypten, was bedeutet, dass der Einfluss durch Imam Laith dort noch immer stark war. Folglich kann man sagen, dass Imam Shafi'i auch durch diesen Einfluss heranreifte und seine Methode einen Wandel durchmachte. Die Annahme, dass der Umgebungswechsel der Grund für die Veränderung von Imam Shafi'is Methodik ist, ist sehr unpräzise und unbegründet. Was ist mit Umgebung gemeint? Der ägyptische Boden? Der Nil? Die Lebensart dort? Tatsache ist, die Umgebung hat mit all dem nichts zu tun. Die Lebensart war sowohl in Ägypten, als auch in Bagdad, Medina und Mekka die gleiche. All diese Orte hatten den gleichen islamischen Lebensstil in der gleichen Epoche. Die Unterschiede in einigen Bräuchen eines Gebiets machen eine Umgebung nicht gleich andersartig. Ein neuer Brauch in einer neuen Ortschaft zwingt einen Mujtahid möglicherweise dazu, diesen zu studieren und eine neue Rechtsregel für diesen spezifischen Brauch abzuleiten, weil es das erste Mal ist, dass der Mujtahid diesem Brauch begegnet. Der Rechtsspruch für eine Problematik der Leute in Bagdad und das Gesetz (Hukm), das auf diesse Leute in Bagdad angewendet wird, sollte der gleiche für die Leute in Ägypten, im Hejaz (Arabische Halbinsel), in England oder in den USA sein. Riba ist in Ägypten und in Bagdad, in England und in Lahore verboten (haram). Die veränderte Umgebung ist kein Grund Riba in Ägypten zu erlauben, während es in Bagdad verboten ist. Um die Menschen zu überzeugen, sagen diejenigen, die behaupten, eine andere Umgebung würde einen Wandel der Methode bedeuten, dass Imam Shafi'i von einem Staat in einen anderen zog. Tatsache ist jedoch, dass sowohl Bagdad als auch Ägypten Teil eines Staates waren. Bagdad und Ägypten waren keine verschiedenen Staaten. Es gab zu dieser Zeit keinen spürbaren Unterschied zwischen Bagdad und Ägypten. Der einzige Unterschied war die Existenz von Imam Laith, der seinerseits von vielen Schulen des Fiqh beeinflusst wurde. Imam Shafi'i wurde, bevor er in Ägypten ankam, von den Rechtsschulen in Medina und Kufa (im Irak) beeinflusst. In Ägypten jedoch hatte er die Chance, die Schule von Laith kennenzulernen. Dies führte dazu, dass Imam Shafi'i in seinem Denken weiter heranreifte. Thematiken, wie das beispielsweise eine Frau zum Islam konvertiert, während ihr Mann Nicht-Muslim bleibt, ist keine neue Thematik. Dieses Problem war bereits zur Zeit des Propheten (saw) zu beobachten, als seine Tochter Zaynab (ra) den Islam annahm, während ihr Mann Nicht-Muslim blieb. Um also dieses Problem in der heutigen Zeit zu lösen, müssen wir lediglich die Rechtsquellen diesbezüglich untersuchen und den islamischen Rechtsspruch diesbezüglich ableiten.
